This presentation will deal with ethical issues raised by the leading US
Supreme Court decisions establishing a federal constitutional right to privacy
in the areas of intimate personal relations and conduct.
We will discuss the ethical obligations of judges and attorneys in
deciding, arguing and criticizing these and other politically divisive
cases - both in legal and public forums.
The context will be an analysis of the issues of constitutional theory
raised by such decisions as Griswold, Roe, Bowers v. Hardwick, Casey, and
Lawrence v. Texas, and the arguments condemning and supporting the
reasoning of these and related cases. Also included will be a
discussion of the ACLU's defense of Rush Limbaugh.
